The Regulations are pursuant to Article 39 of the Statute for Prevention and Control of Animal Disease and Paragraph 1, Article 21 of the Plant Protection and Quarantine Act.
Animals, plants and their products (regulated articles, hereinafter) carried by passenger or crew of vehicles, vessels and aircrafts (inbound/outbound personnel, hereinafter) or sent by mail, within the specified variety and quantity of the Annex, are eligible
for the Regulations.
Regulated articles not in compliance with the preceding Paragraph are subject to general import/export quarantine inspection process.
Charges for quarantine inspection, attending service, overtime service and quarantine labeling are exempted for regulated articles specified in Paragraph 1 of Article 2; other operational fees and costs are collected in accordance with relevant regulations.
Outbound personnel carrying regulated articles which quarantine inspection is required by the importing country shall complete the application form and apply for export quarantine inspection to the animal and plant quarantine authority with the presence of
passport, ticket and other relevant documents.
Quarantine tags are issued by the animal and plant quarantine authority for outbound regulated articles after inspection with no evidence of infection with diseases/pests. Alternatively, animal health/phytosanitary certificates may be issued when importing
country requires one or more of the following:
（1）Animal health/phytosanitary certificates,
（2）Additional declarations, and/or
（3）Statement of quarantine treatment.
Inbound personnel carrying regulated articles shall complete the application form and apply for import quarantine inspection to the animal and plant quarantine authority with the presence of passport, customs declaration form, original of animal health/phytosanitary
certificates and other relevant documents.
The inbound personnel or their responsible agents shall be present during the inspection process.
Inbound personnel carrying animal regulated articles shall follow the following regulations:
（1）Regulated articles from or transshipped through animal disease infected countries/areas from where their entry is prohibited and fail to meet the regulations shall be returned or destroyed.
（2）Animals from animal disease free countries/zones or infected countries/areas where import is allowed under certain conditions shall be accompanied by the letter specifying quarantine requirements from the animal and plant quarantine authority and the animal
health certificate issued by the exporting country and presented for inspection.
（3）If quarantine isolation is required for the imported animals, the inbound personnel or their responsible agents shall apply for approval to animal and plant quarantine authority before entry. The animals shall be escorted to the designated premises for quarantine.
The inbound personnel carrying plant regulated articles shall follow the following regulations:
（1）Regulated articles originated or transshipped through countries/districts from where the regulated article is prohibited to entry due to quarantine pests that fail to meet the regulations shall be returned or destroyed.
（2）Regulated articles subject to conditional quarantine requirements according to Article 16 of the Plant Protection and Quarantine Act, shall be accompanied with a phytosanitary certificate issued by the quarantine authority of the exporting country, and the
inbound personnel shall apply for import inspection.
（3）When bringing in living plants or propagating materials that are subject to post-entry quarantine, the inbound personnel or their responsible agents shall apply for approval to the animal and plant quarantine authority before entry. The living plants or
propagating materials shall be escorted or sealed and transported to the designated nursery for post-entry quarantine after approval.
The animal and plant quarantine authority shall issue animal health/phytosanitary certificates for the inbound regulated articles that meet quarantine regulations. When treatment, isolation, bonding at the customs for reshipment or destruction is required,
the animal and plant quarantine authority shall issue the “Notification of Non-Compliance of Imported Animals/Plants or Products.”
Personnel with diplomatic privilege carrying regulated articles (including those in their unaccompanied baggage) shall apply for inspection in accordance with the Regulation.
For regulated articles sent by mail, provisions of Article 3 to Article 10 shall apply mutatis mutandis.
The Regulations should come into effect on the date of promulgation.
